Had a very special result in the Court of Appeal before Christmas. Thank you to Michael Green SC and Bradley Dean for your hard work, mentorship and guidance through this matter, and to NLS Law for your pro bono support, which is invaluable to those in society who often need legal assistance the most.
Last month the Court of Appeal upheld a challenge to the jurisdiction of the Children’s Court of NSW brought by the birth mother of two Aboriginal children with respect to the power of the Children’s Court and officers of the Department of Communities & Justice to permit her children to remain in the United Kingdom in the care of two British Nationals. The Court of Appeal granted leave to appeal and quashed orders made by the Children's Court in 2022. 8 Wentworth Chambers congratulates Bradley Dean and Elizabeth Lambert, led by Michael Green SC of Level 22 Chambers and instructed by NLS Law, for their work on this important case. The judgment is cited as DN v Secretary, Department of Communities and Justice [2023] NSWCA 321.

10am today the decision of NSW Court of Appeal came down that made me smile. It reminded me all those countless hours and what I do is worth it. A successful outcome and a significant impact it will have. As reported in the Judgement: “This issue as to the jurisdiction of the Children’s Court of New South Wales with respect to children living overseas at the time the orders are made is a matter of public importance for the administration of State welfare laws affecting children and young people”. We took on this case pro bono and I am so grateful to Michael Green SC, Brad Dean and Elizabeth Lambert, Ayden Shepherd and Lucy Coren for all their hard work, dedication and trust in me to take this case and their belief in the importance of the issues in this case. Now on 14 October 23 we have another important moment in history when Australians will vote in a referendum about whether to change the Constitution to recognise the First Peoples of Australia by establishing an Aboriginal and Torres Strait Islander Voice.
