Buying or Selling

Settlement is the legal transfer of the ownership of land or buildings from one person to another.

Strata Title Applications

If you own land and are thinking about subdividing it so that you can sell, build on, or rent the different lots, we can help you prepare your Application to Landgate.

Lost Titles

Have you misplaced your original property Title? No need to panic. We can deal with Landgate and get you a replacement in no time.

Change of Name

Need to change your name in your property Title? Let us take all the hassle away and handle the required paperwork for you.

Deceased Estates

In the event of a relative or friend passing away, if they owned or part-owned a property, their name would need to be removed from the property Title. In such a difficult time, we can help you sort out all the paperwork required to transfer the ownership of the property.

Court Order Transfers

When a property is owned by two people, and they decide to go separate ways, a Court can make an ‘Order’ which allows one or more properties to be transferred from joint into sole names. Thus, we can help transfer a shared property into one person’s name with nominal stamp duty.

What is the role of a Settlement Agent?
A Settlement Agent can help you sort out all the paperwork involved in changing the name on property title deeds. Whether you’re buying a new home and the name on the property Title needs to be replaced from the seller’s to yours, or you’re getting married, or you are the Executor of a deceased estate and need a new name to appear on the Title, a Settlement Agent can do this for you.

Our Settlement Agency, based in Perth, WA, can help you with all the above, taking away all the related stress so that you can focus on the things that matter to you.

When acting for a Seller:

Should you choose us as your Settlement Agent when selling your property, we will undertake the following tasks on your behalf:
  • Prepare Offer and Acceptance (if required), including liaison with all parties to ensure conditions are met.
  • Undertake a title search to confirm the property’s owner and obtain information about any claims on the title.
  • Identify you as the Seller to ensure you have the right to transfer the land/property.
  • Obtain information about any rates that need paying and calculate any financial adjustments.
  • Coordinate banks, solicitors and agents to ensure the settlement is done on time.
  • Attend settlement on your behalf.
  • Ensure the effective release of any mortgages over a property.
  • Make sure the deposit for the sale is paid into your nominated bank account(s).
  • Attend to the payment of the Real Estate Agent’s commission.
  • Ensure any outstanding rates are paid.

When acting for a Buyer:

Should you choose us as your Settlement Agent when buying property, these are the tasks we will be undertaking on your behalf:

  • Review Offer and Acceptance, including liaison with all parties to ensure conditions are met.
  • Undertake a title search to confirm property ownership and obtain information about any claims on the title.
  • Prepare transfer documentation.
  • Attend to payment of stipulated stamp duty.
  • Obtain information about the rates that need paying and calculate any financial adjustments.
  • Coordinate banks, solicitors and agents to ensure the settlement takes place on time.
  • Attend settlement on your behalf and lodge necessary documentation at Landgate (if required).
  • Ensure outstanding rates are paid.
  • Advise rating authorities (council, etc.) of a property transfer.
