Here's a brief overview: 📌 Background: Mr. Alelaimat, working under DJ Scaffolding Services Pty Ltd (DJSS), suffered an injury while at a construction site in Artarmon, Sydney. He was compensated under the Workers Compensation Act 1987 but later started a claim against WCNI and Synergy Scaffolding Services Pty Ltd, who supervised his work. 📌 Incident Details: While assisting in dismantling scaffolding upon instruction, Mr. Alelaimat was injured by a falling metal piece. Post-injury, he was advised to identify as a DJSS employee, hinting at possible insurance complexities. 📌 Trial Outcome: The primary judge held Synergy accountable for not setting up safety measures, ordering them to pay damages to Mr. Alelaimat and also to indemnify WCNI for certain payments. 📌 Appeal Highlights: Synergy, in their appeal, primarily questioned DJSS's duty of care to Mr. Alelaimat and the implications of section 151Z of the Workers Compensation Act. 📌 Appeal Outcome: The Court of Appeal emphasised that labour hire employers cannot escape liability by claiming they had no control over the contracting party's negligence.     🏛️💼 Navigating Costs in Litigation: Insights and Takeaways from Ford v Nominal Defendant [No 2] [2023] QCA 181 In the evolving realm of #PersonalInjury and #InsuranceLaw, the case of Ford v Nominal Defendant serves as a lesson in indemnity costs for parties. Central to this application heard on the papers was Rule 360 of the Uniform Civil Procedure Rules 1999 (Qld) - a rule that promotes meaningful negotiations and urges parties to consider the financial stakes carefully before stepping into a courtroom. For insurers, the case illustrates the importance of a reasoned evaluation of a plaintiff's offers, mindful of the big picture a court will later look at in respect of costs. It serves as a wakeup call to approach negotiations in "all or nothing" cases with regard to: 👉 the range of possible outcomes at trial (and appeal) 👉 the quantum of the case 👉 the concessions already made by an opponent 👉 and, the gap a plaintiff will have between standard and indemnity costs in the late stages of litigation.
