Should a liquidator of a trustee need court orders to deal with assets of a trust? When a corporate trustee enters external administration, all associated trusts also come under administration. Although the external administrator has access to the trustee's resources, gaining court permission to access trust assets is a time-consuming and expensive process which impacts the available funds for distribution to trust creditors. Legislative change is required to remove this largely unnecessary burden with court intervention reserved for contentious cases. Some have suggested simply informing the trust beneficiaries would give the administrator access to the trust assets, however this gives rise to the second problem. There is no register of trusts and their beneficiaries. How will an administrator identify the beneficiaries and their contact information in order to give such notice?
