    eDiscovery Confidence Surveys are a useful way to take the pulse of attitudes and expectations in the eLitigation space. The recent Spring 2024 eDiscovery Business Confidence Survey [https://bit.ly/4axPRlz] paints a generally rosy picture of current and anticipated activity levels across the EDRM landscape. In an industry that seems to be currently dominated by the impact and potential of AI and LLMs, it was interesting to see that the greatest challenge identified by respondents was “Increasing Types of Data”. Evolving data types need to be identified, collected, analysed, reviewed and ultimately presented at hearing. It’s a challenge that is top-of-mind for our team at elaw, who routinely engage in research, development and testing of potential evidence formats and the most effective ways to cater for them using software and methodology.     An article this week in Law.com highlights a significant defect when using software designed for videoconferencing to present electronic evidence via screen-sharing functionality at deposition or hearing: the risk of inadvertently disclosing privileged information.   Notifications for emails or instant messages may pop up on the presenting lawyer's screen while it is being shared in the videoconference, leading to inadvertent disclosure and breaches of confidentiality.   The authors of the article advise legal professionals to "take all reasonable steps to mitigate the risk of inadvertent disclosures". They recommend turning off email and instant messenger notifications or ensuring they are displayed on a second monitor. Instead, why don't we encourage practitioners to use technology that is actually designed for presenting evidence?
